The Supreme Court has directed the Dean of Byramjee Jeejeebhoy Government Medical College in Pune to form a medical board to assess whether a student with a speech and language disability exceeding 40% is eligible to complete an MBBS course. This follows a challenge against the Bombay High Court’s decision, which denied interim relief to the petitioner whose admission was canceled due to a 44-45% speech disability. The petitioner argued that his disability does not hinder his ability to complete medical education and that the 1997 regulations barring candidates with over 40% disability from MBBS courses contradict the Rights of Persons with Disabilities Act, 2016. The Supreme Court granted interim relief, ensuring the petitioner’s seat remains vacant until a final decision is made.
